OTED-Valley Acquisition LLC, "Valley", its faculty, staff, consultants, and other personnel do not warrant, authorize, guarantee, or assure that the information contained in MemoryMaster™, the Review Course, or any other products sold by Valley can or should be used for the practice of the art and science of medicine, or anesthesiology. The MemoryMaster™ content and Review Course materials are intended to be used as preparation tools for the certification exam, or as a review for certain topics the authors deem important, which pertain to the art and science of anesthesia. While we are confident that our educational materials will be helpful in assisting the participant, we can not guarantee that your participation in this review course and studying the recommended materials including the MemoryMaster™ content will assure success on the certifying examination. The authors refer the user to cited textbooks, medical journals, and other sources regarding the art and science of anesthesiology. Utilization of doses, methods, quotes, facts, concepts, and other materials by the user is at the user’s own risk. The user shall not hold liable faculty, staff, consultants, and/or other personnel associated with Valley, for the information in MemoryMaster™ and/or the Review Course, nor may the user hold any of the above-named liable or responsible as a result of the use of the information contained in any of the materials or lecture furnished by Valley, or their personnel.

Valley, through its employees/agents, will not be responsible for any failure to perform any term or condition of the Agreement as a result of conditions beyond its control including, but not limited to, COVID, CDC guidelines, travel restrictions, governmental restrictions, faculty illness or emergencies, internet connectivity, service failures, equipment failures, power failures, health conditions, internal or environmental distractions, weather, fires, war, strikes, acts of God, or any other act beyond its control and thus it shall not be deemed a breach of this Agreement and clients will not be entitled to any reimbursements from Valley for damages sustained. 

Valley reserves the right to cancel, reschedule or replace any review course at any time, including substituting a live or pre-recorded webinar for an in-person review course. Valley is not liable for any travel expenses or cancellation fees incurred by the user.

Payment for the Review Course and/or MemoryMaster™ products shall constitute an acknowledgement by the user that he/she has read this Disclaimer, understands its contents and agrees to be bound by its terms. There are no refunds for shipped materials or products.
